Retirement Benefits Disclaimer

1. PURPOSE

Brigham Young University–Hawaii ("BYU–Hawaii" or "university") reserves the right to terminate or amend any of its benefit programs.

2. POLICY

Pursuant to the Employee Retirement Income Security Act of 1974 (ERISA), it is understood that the university has the right to amend or terminate any of its retirement benefit plans, in whole or in part, or to establish other retirement plans in any way which seem advisable to the President in his/her discretion, provided that any amendment to retirement benefit plans will not prejudice any rights or retirement benefits already vested.

3. IMPLEMENTATION

The university also reserves the right, in individual cases where exceptional condition exist, to modify the provisions herein set forth governing the amount and application of the university’s contributions and benefit programs.

The policies on this website (including any university procedures, processes, benefits, courses of conduct, or oral or written statements arising from or related to these policies) do not constitute any legally enforceable contract, obligation, or liability on the part of the university, except to the extent that they are incorporated by reference into a written agreement signed by an authorized university official. These policies do not alter the “at-will” employment status of any university employee hired on an “at-will” basis. The university reserves the right to interpret, revise, or withdraw these policies at any time and at its sole discretion.
